Terms of Use

1) Who We Are & What This Is

These Terms of Use constitute a legally binding agreement between Harium ("Harium", "we", "us") and any person who accesses or uses the Harium application and related services (collectively, the "Service"). By installing, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2) Eligibility & Accounts

You must be of the age of majority in your jurisdiction or have verifiable parental consent if you are a minor (see Children’s Privacy). You agree to provide accurate information, to maintain the confidentiality of your credentials, and to be responsible for all activities that occur under your account.

3) License to Use the App

Subject to your continued compliance with these Terms, Harium grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on devices that you own or control, strictly in accordance with these Terms and the applicable rules of the Apple App Store and Google Play. You shall not: reverse engineer, decompile, or disassemble the App; circumvent or attempt to circumvent any security or access control; use the Service for unlawful purposes; engage in abusive automation; or sell, rent, lease, or transfer accounts or access.

4) Content & IP

The Service, including all content, artwork, code, text, graphics, and virtual items, is owned by Harium or its licensors and is protected by intellectual property laws. Except for the limited license expressly granted herein, no rights are granted to you by implication or otherwise. If you submit user content (e.g., usernames, avatars, achievements), you grant Harium a worldwide, non-exclusive, royalty-free license to host, reproduce, display, and otherwise use such content solely for the purpose of operating and improving the Service.

5) Purchases & Subscriptions

The Service may offer in-app purchases and auto-renewing subscriptions. You can manage or cancel subscriptions via your platform account settings (iOS: App Store > Account > Subscriptions; Android: Google Play > Payments & Subscriptions). Refunds, if any, are handled by Apple or Google in accordance with their policies. Trial periods, where offered, convert to paid subscriptions unless canceled in advance of the trial end. Virtual currencies or items within the Service have no real-world monetary value and are non-transferable and non-redeemable.

6) Acceptable Use

You agree to use the Service solely for its intended purpose in a lawful, respectful, and safe manner. You shall not engage in harassment or abusive behavior; cheating or exploiting mechanics; hacking or interfering with the Service; or violating others’ privacy or rights.

7) Updates & Changes

Harium may update, modify, or discontinue all or part of the Service at any time to improve performance, security, or compliance. Where required by law, we will provide notice of material changes. Your continued use of the Service after changes become effective constitutes your acceptance of the changes.

8) Third-Party Services

The Service may integrate or link to third-party services (e.g., analytics, crash reporting, notifications, payments). Harium is not responsible for third-party websites, terms, or privacy practices, and your use of such services is governed by the applicable third-party terms.

9) Disclaimers

To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. Harium does not warrant that the Service will be uninterrupted, secure, or error-free.

10) Limitation of Liability

To the maximum extent permitted by law, Harium shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or related to your use of the Service. In no event shall Harium’s aggregate liability arising out of or relating to the Service exceed the amounts you have paid (if any) to Harium for access to the Service during the twelve (12) months immediately preceding the event giving rise to liability.

11) Indemnification

You agree to defend, indemnify, and hold harmless Harium and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or misuse of the Service.

12) Termination

Harium may suspend or terminate your access to the Service at any time if you breach these Terms or if we are required to do so by law. You may cease using the Service at any time, and you may request deletion of your account pursuant to our processes.

13) Governing Law

These Terms and any dispute or claim arising out of or in connection with them shall be governed by the laws of the Kingdom of Saudi Arabia. The courts of Riyadh shall have exclusive jurisdiction, except where mandatory law provides otherwise.

14) App Store/Google Play Terms

On iOS, the Apple Media Services Terms (including the Licensed Application EULA) apply. On Android, the Google Play Terms apply. You must comply with all applicable platform terms.
